JOVENS GÊNIOS is a Digital Platform aimed at deconstructing the bicentennial model of education and revolutionizing Brazilian education in the exponential era, bringing a fun and intelligent way of learning.

In order for all information to be correctly understood, we present our Privacy Policy in a transparent and accessible way, as indicated below.

Categories of Registered Users on the Jovens Gênios Platform:
 

  • Contracting School: An educational institution that has entered into a contract with Jovens Gênios to provide the Platform's services to students, legal guardians of students, educators, and managers.

  • Families: Legal guardians of underage Explorers.

  • Explorers: Students from Contracting Schools.

  • Educadores: Teachers from Contracting Schools.

  • Managers: Principals and coordinators from Contracting Schools.

CHAPTER I – GENERAL TERMS

1.1. General
This Privacy Policy is designed to communicate our practices regarding the processing (including collection, storage, use, sharing, etc.) of personal data of USERS of JOVENS GÊNIOS (hereinafter referred to as the "Platform"), which includes the website and its subdomains, applications, programs, and other extensions. The Platform is owned by JOVENS GÊNIOS PROVEDOR DE CONTEÚDO LTDA., a private legal entity, registered with CNPJ/MF under number 29.286.289/0001-39, headquartered at 120, Mena Barreto Street, Botafogo, in the city of Rio de Janeiro/RJ, ZIP Code 22.271-100, and is under its responsibility and management.

1.2. What are Personal Data?

Personal data are those provided by USERS that can be used to identify USERS individually.

1.3. Authorization for Information Collection.
By using the platform, you must accept and authorize the collection of information only for the fulfillment of the contracted services, through the "I have read and agreed to the terms" button, in accordance with this privacy policy.

1.3.1. You may withdraw your consent to the provisions of this Privacy Policy at any time by notifying JOVENS GÊNIOS through the email address contato@jovensgenios.com, within 05 (five) business days.


1.4. Regulation.
The Platform operates in accordance with Brazilian legislation, including and especially, the terms of Law No. 12.965/2014 (the Brazilian Civil Rights Framework for the Internet) and Law No. 13.709/2018 (General Data Protection Law), as well as other applicable laws.

1.5. Contact.
In case of doubts or suggestions about the Platform's Privacy Policy or any other information, USERS can contact the administrators via email at contato@jovensgenios.com, which will be answered during business hours, from Monday to Friday, from 9:30 AM to 6:00 PM.

1.6. Information Control.
This Policy describes what personal data may be collected from the USER while using the Platform's services, how this information may be used, and the precautions taken against unauthorized access or use of this information.

CHAPTER II - PERSONAL DATA COLLECTED

2.1. JOVENS GÊNIOS may collect, store, and use the following information and/or personal data of USERS:

2.1.1. Personal data of FAMILIES:
Full name;
Email;
CPF;
Address;
Phone number;
Credit card information.

2.1.2. Personal data of EXPLORERS:

Full name;
Grade level;
Date of birth;
Email;
Class.

2.1.3. Personal data of EDUCADORES:

Full name;
Email;
Classes they are involved with.

2.1.4. Personal data of MANAGERS:

Full name;
Email;
Name of the Contracting School.

2.2. JOVENS GÊNIOS may also collect, store, and use the following information:

  a. Records in a database of any files or information uploaded to JOVENS GÊNIOS by the users;
b. Details of access to JOVENS GÊNIOS and the resources that the user accessed;
c. Information about the device used for access, including, for example, hardware model, operating system and version, names and versions of files, language preference, unique device identifier, advertising identifiers, serial number, device movement information, and network information;
d. Server log information that may include device IP address.
e. Browser click mapping, browsing data, statistics, demographics, among others.
f. Application click mapping and browsing data.

2.3. Native Applications.
Native applications may store usage data, images, videos, text, access password to the biometric system, which are not shared with JOVENS GÊNIOS.


CHAPTER III - SHARING OF COLLECTED PERSONAL DATA

3.1. Exceptions for Sharing Personal Data.
JOVENS GÊNIOS does not disclose any personal data provided by USERS through the JOVENS GÊNIOS platform to third parties, except in the following cases:


  1. Cases in which JOVENS GÊNIOS is obligated to disclose or share the collected data to comply with a court order or to prevent fraud or other crimes, as well as in response to a request for information from a competent authority, if we believe that the disclosure is in accordance with or required by applicable laws, regulations, or legal procedures;

2. To protect the rights, property, or safety of JOVENS GÊNIOS and the Platform;

3. With law enforcement agencies and/or government authorities, if their actions are deemed inconsistent with the provisions in our terms of use, or to protect the rights, property, or safety of JOVENS GÊNIOS, its Users, or others;

4. Upon the actions of EXPLORERS or the FAMILIES;


5. In cases of partial or total sale of the business or its assets, or as part of any business reorganization or restructuring, merger, division, or incorporation, so that JOVENS GÊNIOS may share User information with third parties involved in such businesses, taking necessary measures to ensure that privacy rights continue to be protected, as per this Policy.

6. To enable MANAGERS to monitor the pedagogical development of EXPLORERS from the Contracting School, through the JOVENS GÊNIOS Platform and via monthly reports sent by email.

  7. With Amazon Web Services for hosting applications and databases with Users' personal data.

  8. With Firebase for hosting some data and functionalities of the Platform.

3.2. Contact and Disclosure Authorizations.

USERS authorize JOVENS GÊNIOS to contact them using any of the contact methods provided in their registration on JOVENS GÊNIOS.

CHAPTER IV - COOKIES
 

4.1. What Are Cookies?

A cookie is a piece of information stored locally on the user's computer or device, containing information about their internet activities.

 

4.2. Types of Cookies Used.

Cookies can be used in various ways and forms. JOVENS GÊNIOS may use:



1. Performance Cookies: This type of cookie collects anonymous information about how the USER uses the platform so that we can optimize it. The information collected by these cookies never contains personal details that could identify you.
 

2. Functional Cookies: These cookies are used by JOVENS GÊNIOS for some of its features, aiming to provide you with a better browsing experience on the platform.
 

3. Advertising Cookies: These cookies collect information about your browsing habits to make advertising more relevant to you and your interests. They remember the websites you have visited and share this information with other advertisers. In our case, we use third parties like Google to provide you with more relevant ads while you visit other websites on the internet.

4.3. Access to Cookies.
Access to cookies ends when the USER closes the browser. The USER can choose to accept or decline cookies.

4.4. Consent for the Use of Cookies.
USER consent is required before the session starts for cookies to be used.

4.5. Cookie-Free Option.
The USER can choose to decline the use of cookies. If the USER chooses not to accept them, their access to most of the information available on the Platform will not be compromised. However, the USER may not be able to fully utilize the services offered.

CHAPTER V - ACCESS AND CORRECTION OF PERSONAL DATA
 

5.1. Access and Rectification of Personal Data.

USERS have the right to access their personal data held by JOVENS GÊNIOS, especially EXPLORERS and their legal guardians, by contacting the administrators via email at contato@jovensgenios.com, which will be responded to during business hours, from Monday to Friday, from 9:30 AM to 6:00 PM in the time zone of the requesting legal guardians, within a period of 15 (fifteen) days, along with a description of the manner, purpose, and duration of the processing of personal data, which may be sent via email or through a letter, in accordance with Article 9 of LGPD (Brazilian Data Protection Law).



5.2. Deletion.
USERS, especially EXPLORERS and their FAMILIES, have the right to request the deletion of their personal data stored by JOVENS GÊNIOS at any time, except in cases where there is a legal obligation or a judicial decision requiring the retention of data, in accordance with the provisions of Articles 18 and 16 of LGPD (Brazilian Data Protection Law).
 

5.3. Inaccuracy of Information.

It is the responsibility of the data subject to keep their information up to date, and in the event of inaccuracy, JOVENS GÊNIOS may update or delete them, except in cases where it is necessary to maintain them for legitimate commercial or legal purposes.

 

5.4. Necessary Protection Measures.

JOVENS GÊNIOS takes all necessary security measures to protect the personal data of USERS and to safeguard them against unauthorized loss, misuse, access, disclosure, alteration, or destruction.

 

5.5. Password Protection.

USERS are also responsible for taking appropriate measures to protect their passwords, usernames, and other special access resources for their personal registration with JOVENS GÊNIOS.



CHAPTER VI - NOTIFICATION OF PRIVACY POLICY CHANGES

6.1. Changes in Privacy Policy.
JOVENS GÊNIOS may change the Privacy Policy of the Platform from time to time. The use of collected information is subject to the current Privacy Policy. If JOVENS GÊNIOS makes changes in how it uses personal information, it will notify USERS by sending an email.
 

6.2. Unnotified Adjustments.

Minor adjustments to this Privacy Policy may occur without significantly affecting the ways in which JOVENS GÊNIOS handles collected information, so these adjustments do not need to be notified.

 

CHAPTER VII - COMMUNICATION

 

7.1. Sending Communications.

By registering, USERS agree that JOVENS GÊNIOS may send notifications, advertisements, updates about services, and important information regarding the use of the Platform that require their attention to their email.

 

7.1.1. Opt-Out Option.

Upon receiving an email on behalf of the Platform, there will be an option to unsubscribe from further emails, using the opt-out option or by making a request via email.

 

7.2. Anti-Spam Policy.

The Platform takes necessary precautions to prevent the sending of unsolicited emails.

 

7.3. Confidentiality.

Maximum confidentiality is ensured in the handling of phone numbers and email addresses during regular administrative tasks of JOVENS GÊNIOS.


CHAPTER VIII - PERSONAL INFORMATION SECURITY
 

8.1. Storage.
The personal data of USER accounts are securely stored and all platform information is securely transmitted, stored on an Amazon Server located in the State of Virginia, United States of America. Only authorized employees of JOVENS GÊNIOS can access your personal information, and they are required to strictly adhere to confidentiality duties and respect your privacy under the terms of this Policy.

 

8.2. Information Security.
All flows of JOVENS GÊNIOS are encrypted, subject to data backup, monitoring tools, security policies, access controls for employees, and updated security software.

 

8.3. Notification.
If JOVENS GÊNIOS becomes aware of any breach of its own security or hosting companies, including any hacker or other data breach, we will notify national authorities and the potentially affected USERS about the breach and provide maximum details regarding the nature, extent of the breach, and compromised data within a reasonable timeframe, in accordance with the provisions of Article 48, § 1 of LGPD (Brazilian Data Protection Law).

 

8.4. Responsibility.
USERS will be responsible for indemnifying JOVENS GÊNIOS for all costs and damages that it may incur as a result of the violation of this Privacy Policy by them.

 

8.5. Cooperation.
JOVENS GÊNIOS fully cooperates with any authorities or courts requesting the disclosure of the identity or location of any person who has inserted any material on the Platform that violates the clauses outlined in this Policy.

 

8.6. Limitation of Liability.
This Privacy Policy only addresses the use and disclosure of information collected by the JOVENS GÊNIOS Platform. If USERS disclose their information to third-party websites, different rules may apply to their use of the information.

 

8.7. Data Protection Officer.
